1. Introduction
These Terms and Conditions ("Terms") apply to the services provided by Kylie Thomas Pty Ltd ("we", "our", or "us"), an online clinic offering psychology and psychosexual therapy services to clients residing in Australia. By accessing or using our services, you ("the client", "you", or "your") agree to these Terms. Please read them carefully.
2. Services Provided
We provide psychological services via secure online platforms. All sessions are conducted by a registered psychologist. It is important to note that psychosexual therapy is talk therapy only. No nudity, sexual acts, or physical demonstrations are involved in any therapy session.
3. Eligibility for Services

Our services are available to residents of Australia who are 18 years or older.

Clients must ensure they have a stable internet connection and access to the appropriate device (computer, tablet, or smartphone) to participate in online therapy sessions.

You are responsible for ensuring that your location during the online session is private, safe, and free from distractions, such as being in a stationary environment (e.g., not driving a vehicle or in any environment that could pose a risk to your safety or the quality of therapy).
4. Appointments and Cancellations

Appointments can be scheduled by using the online booking system or emailing us directly at info@kyliethomas.com.au

Appointments must be confirmed at least 72 hours before the scheduled time. If an appointment is not confirmed, it may be offered to a client on the cancellation/waitlist.

Appointment reminders are sent as a courtesy to assist clients in keeping track of their commitments. However, it remains the client’s responsibility to remember and attend their appointment, regardless of receiving a reminder.

Cancellations or rescheduling must be made at least 48 hours prior to the scheduled appointment. Late cancellations or missed appointments will incur a cancellation fee of the full fee session.
5. Fees and Payment

Fees for each session will be communicated upon booking. Payment must be made at the time of booking or immediately after the session, unless otherwise arranged.

We accept payment via credit/debit cards.

To streamline our appointment system and provide the best service, we require clients to provide valid credit or debit card details upon scheduling an initial appointment to confirm the booking.

Clients have 24 hours from the time of booking to submit their credit card details. An intake form will be provided to facilitate this process.

If credit card details are not received within 24 hours, the appointment will be automatically cancelled, and clients will need to reschedule and provide the required details.

Credit card details will be securely stored and will not be shared with unauthorised third parties. The card will only be charged under the cancellation policy or upon payment for your appointment.

The cancellation and no-show policy applies once the appointment is confirmed with your credit card details.
6. Confidentiality and Privacy

Your confidentiality is a top priority. All personal information and therapy records are securely stored in accordance with the Privacy Act 1988 (Cth) and the Australian Health Practitioner Regulation Agency (AHPRA) guidelines.

Online sessions are conducted on secure platforms. We recommend using a private and secure internet connection to further protect your information.

Confidentiality will only be breached in cases where:

There is a risk of harm to yourself or others.

We are legally required to disclose information (e.g., by court order).

You provide written consent for us to share information.

7. Informed Consent

By engaging in therapy, you acknowledge that Kylie will collect and retain personal information relevant to your assessment, diagnosis, and treatment. This information will assist in providing an informed and effective psychological service. While you may withhold certain personal details, doing so could limit the services that can be provided.

All information gathered during sessions is confidential and only accessible to Kylie, unless you provide written permission for it to be shared with others. You may request access to your personal information, except in cases where legal restrictions apply.
8. Communication

For non-urgent matters, you can communicate with us via email. Please allow 2-3 business days for a response.

Our clinic is not a crisis service. If you are experiencing an emergency, please contact emergency services at 000 or go to your nearest hospital. Online communication is not monitored 24/7 and should not be used in emergencies.
9. Limitations of Online Therapy

While online therapy is effective for many people, it may not be appropriate for everyone. Clients with severe mental health issues or those in crisis may require face-to-face interventions or inpatient care.

If we determine that online therapy is not suitable for you, we will provide appropriate referrals.
10. Termination of Services

Either you or your therapist may terminate therapy at any time. We ask that you inform us if you wish to stop therapy.

We reserve the right to terminate services in cases of non-compliance with these Terms, if therapy is deemed no longer beneficial, or if appointments are frequently missed or cancelled.
11. Professional Boundaries and Ethics

Our therapists adhere to the Australian Psychological Society’s Code of Ethics and the Australian Health Practitioner Regulation Agency (AHPRA) standards.

We do not allow dual relationships, such as friendships or business relationships, between clients and therapists to maintain professional boundaries.
12. Liability

We aim to provide high-quality care, but we cannot guarantee specific outcomes from therapy. You acknowledge that therapy can involve emotional discomfort, and results may vary. Kylie Thomas Pty Ltd is not liable for any specific outcomes or consequences arising from the use of our services.
13. Complaints and Dispute Resolution

If you have any concerns about our services, please address them with your therapist. We are committed to resolving any issues promptly and professionally.

If a resolution cannot be reached, you may contact the Australian Health Practitioner Regulation Agency (AHPRA) or the Australian Psychological Society (APS).
14. Changes to Terms and Conditions
We reserve the right to modify these Terms at any time. You will be notified of any changes, and your continued use of our services will constitute acceptance of the updated terms.
15. Governing Law
These Terms are governed by the laws of Western Australia. Any disputes arising from these terms or services will be subject to the jurisdiction of the courts of Western Australia.
